The Supreme Court of Nigeria has reserved its judgment in a significant legal case challenging the constitutionality of the Economic and Financial Crimes Commission (EFCC). Initially filed by Kogi State, this case saw the participation of 16 states challenging the legality of the EFCC’s establishment under Nigerian law. The states argue that the EFCC Act was improperly enacted without following constitutional requirements, especially concerning state legislative approval, making the anti-graft agency’s powers invalid over states that did not endorse the law. However, three states, including Kebbi and Ondo, withdrew from the suit.
The apex court will deliver its judgment after reviewing the submissions from the remaining plaintiffs and the defense by the Attorney-General of the Federation.
